full time college student full time job yet i recieve food stamps

I have applied for a k-1 fiance visa. My fiance lives in Ghana. I am a full time college student and i work full time for our local school district. I am a single mom of three kids and i qualify for food stamps. If i am recieving food stamps even though i am employed will my k-1 visa get denied???? Please help!!!!

You are eligible to receive food stamps as a USC. You can qualify for them even though you meet the poverty guidelines for an affidavit of support.. As long as you meet the income requirement, it should not matter. However, if the CO believes the foreign fiance(e) will also begin to get food stamp benefits when they enter the US(though this is not something you disclose on the I-134), then they could ask for a co-sponsor. The CO has the sole discretion in making that call.

I believe the main point of affidavit of support is to show that the beneficiary will not become a financial "burden" to the state.

In the state of Texas, your income (*I think in the bank after your bills, i stand corrected) should be $150 so in technical sense, you could not "really" qualify unless you have other circumstances and esp. with kids too would make you eligible. So, in the "eyes" of the govt, you can't support yourself so you WONT be able to should your tax info to support your beneficiary.Therefore, you will need a co sponsor.

So, if I were you, I would get off foodstamps because that will be a warning to your co sponsor that he or she may be on the hook should your beneficiary get on foodstamps.

In some cases, the govt could "garnish" wages or withhold tax refund of a co sponsor to pay off your beneficiary getting on govt assistance. . (I've heard about stories of that sort)..

**I totally stand corrected on the claims I have made here if anyone has a verifiable info to contradict mine..

The only information I have found on the USCIS website is that you will be denied if you DO NOT have employment and are recieveing any form of GOV't assistance. It says nothing about working full time and being a full time student and still qualifing for food stamps. I appreciate everyone's input thank you

That is correct. If you meet the income requirements for the affidavit, then it should be accepted. There is no place to list that you are on food stamps, not that the government cannot check that for themselves, but it is not something asked on the forms. You provide your most recent tax return, letter from employer and/or recent pay stubs to prove your current income. You and your children are US citizens and eligible to receive food stamps. You can make more than is required for the affidavit of support and still qualify for food stamps. These are the poverty guidelines > http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf

I think you should have a co-sponsor lined up, just in case one is needed, but it may not be necessary.

I really wish people on this forum would stop giving advice on things they know nothing about. LPRs who have not been in the country for 5 years would have real difficulty obtaining foodstamps in most states, so the government is not concerned.

People that are not supposed to be eligible somehow receive public assistance all the time. Stating they are not interested is something I disagree with. You are correct in that they are not supposed to consider whether or not the beneficiary will receive food stamps in the future because they are not considered public cash assistance for income maintenance. A CO seems to have a lot of leeway in what they will accept for the I-134 though, and the decision is completely up to them. That is the only reason I suggested to get a co-sponsor lined up just in case the CO asks for one. With the income of the OP meeting the requirement, I doubt the co-sponsor will be needed, but no one knows for sure what the CO will decide, so covering all the bases is always a good idea.
