Dear All,

Good afternoon,

I have a question regarding Maternity Leave for Lawful Permanent Residents.

I am currently employed in the State of California and I have a couple of questions

regarding the Maternity Leave and would like to know if I qualify for such benefit as a Lawful Permanent Resident.

I gained my temporary permanent residence card through my husband, and it was granted

on February 2014.

Therefore, please kindly report as soon as possible regarding this inquiry.

Yes, of course you are eligible for any maternity leave your work gives you.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

2/06/13: APPROVED!

Timeline

The US does not give "maternity leave". You can use the Family Leave and Medical Act to take unpaid leave if you qualify.

  • You have worked for the employer for 12 or more months.
  • You must have worked a total of 1250 hours in the 12 months prior to taking leave.
  • Your employer must have at least 50 employees within 75 miles of your workplace

Of course if your employer offers leave as a benefit you could use that.

The OP has to be paying into the insurance to collect paid family leave. MOST but not all people pay into it. She can check a paystub to see if there is and entry SDI or CASDI

This will not be over quickly. You will not enjoy this.
