Marriage while waiting on K-1 Dominican Republic

We are current April Filers. Since TSC is just now processing requests from December 2013, my fiancée and I are considering the option of canceling the I-129f and proceeding with marriage and then filing the I-130.

Because of our religious beliefs and Bible trained conscious, we have not had any sexual contact since we met over a year ago. Each time I visit it gets even harder to abstain from sexual intercourse, so we decided to think about the marriage now. Please don't judge us, we just want our marriage bed undefiled by fornication.

Questions:

What are the pros and cons.

If we decide to go ahead with the marriage we have to do it in the DR, so what paperwork do I need to accomplish this?I am the Petitioner and US Citizen.

How long does it take after marriage to file for I-130? Should the waiting time be comparable to K-1 or sooner?

Any and all comments will be appreciated. Thanks in advance.

You will effectively be starting over with a CR-1 petition (the time for the K-1 will not "transfer" to the new petition). CR-1s generally take longer than K-1 VISAs. Here's a comparison chart so that you can decide what option is best for your relationship:

You can search for other couples from the DR to see their timelines and get an idea for how long things will take. One thing to keep in mind is that the "compare" chart doesn't assume any RFEs, nor does it include any time spent in AP, etc.

Why did you have to withdraw your first petition?

Because he has to be married for the CR-1 and thus can not pursue the K-1 fiancee visa.

Why did you have to withdraw your first petition?

I didn't wait the required 30 days after divorce by Texas Law before I filed. By Texas law one is not legally free to remarry after divorce until after 30 days have passed. I filed 12 days after my divorce was final. We had the option to wait for a possible RFE or a dreaded disapproval, so we opted to withdraw and refile after the Texas Law 30 day requirement

She didnt want to have sex with his fiance before marrige

And the k1 was taking long, so they decided get marry.

They didnt cancel the k1 , they just got marry and when the appoinment for the k1 arrived she didnt go to the interview. She didnt call to cansulate either. Her appoinment latter arrived 2 months after she got marry.

She just waited her interview for spouse visa 8 months.

Then she went to her interview and was approved without problem, she is in usa now 7 years now.

So you can get marry without problem. You know that you are going to start over, but I think that can be wuicker that wait for tsc.

Tsc is taking for ever to approved and then you need to wait 3 or 4 months for interview.

There are a lot of informations about what documents you need at Junta central electoral wedsite.

I hope you can read spanish, and if you dont read spanish tell to your fiance that go to a junta central electoral and get the information or he can read on internet and tell you.

Thanks for the link. Good information. Now for discussion, if we decide to marry anyway, what are the required steps and documents or can you direct me to the appropriate source.

I have nothing against people wanting to practice their religion but I am not particularly religious myself.

That said, here is some thought on your situation...don't know if it can work for you guys.

1. Do the official religious wedding ceremony so that you two can be fully intimate.

2. But do not file them into government record in either countries.

3. Continue the I-129F processing so that you are not resetting the visa clock by almost 1 year.

4. Once you are joined in US, simply go to the local county office and get married by peace of justice.

If you can separate the religious ceremony with the official marriage filing with the court,

then, you can be both emotionally and religiously proper for having sex,

but you also keep the current K1 visa processing going.

Did your friend file the I-130 while the I-129f was still active. You stated that it took 8 months after marriage to get interview I-130 so basically she had both applications processing at the same time? Am I correct in this assumption?

Here religous wedding and official wedding go together.

If they get marry in a religous wedding here they cant do k1 process.

Does god approve of finding a new woman while still married? That's not defiling anything?

Yes you are correct.

Her husband apply for the I-130 while the i129f was active.

They approved her k1 petition and sent her the appoinment letter for the k1 but she didnt go to the interview, dhe waited her spouse interview.

Her active i129f didnt affect her I-130 .

She was approved on her spouse

All your fiancee has to do is no go to her interview for her k1. And just wait for her spouse visa.

That's not unusual. A religious marriage in the US is a legal marriage too.

I will not touch your religion question. You do whatever your religious convictions say you need to do, and that is for nobody to judge or question.

The bottom line is that the CR-1 will take longer, but you will be married sooner. It is for you to decide what is more important, being together sooner or being married sooner.
