I130 approved and the petition sent to NVS. But no answers for 60days.... plz help

I am a perminent resident, and got married in Jan and filed I130 on March 5 2014.

I130 was approved on April 8, 2014, and waited for a month as directed on the mail.

After a month, I sent an email to find out the status.... but no response....

Its now two month after the file was sent to NVC. What do I need to do? Do I need to sit and wait until I get response back?

you can call the nvc to see if they have your file. Their number is 603-334-0700. You might get a busy signal but keep trying. It will work eventually :thumbs:

I have a greencard, and my wife is in Korea waiting for the process. I maybe mistakening but I thought I have to file I485.... Do I file 261?

I am looking at your timeline, and wondering if you were inviting your spouse to the U.S as Perminent Resident or a U.S Citizen?

Call them as you're told... My PD is March 11th... Got no email from them.. I had to call them before I was told my case number and IIN....

Some people do receive emails from NVC though giving them their case number

Sorry but can I ask two more questions?

1) This 603-334-0700 phone number were busy for almost two hours, but I call the 1-800 number which was on the letter from INS and spoke with the person. When I spoke with the person, she told me to wait another month to hear from NVS. Should I keep calling 603-334-0700 until someone answer the call?

2) Do I get contacted from NVS or my wife who is in Korea get the contact from NVS?

Click on the link I gave you and read all the instructions. Without them you will not now what to do.

In the same link/forum ask all your questions.

Yes, call NVC everyday until you get a human. Do not wait a month because you will not get what you need on time. Number is 603-334-0700. Calling early in the morning is best, dial & dial until you get someone.

I have to thank you both on telling me direction what to do!! Thank you so much!!

I called 603 number early in the morning and was able to talk to a person after 1 hour and 15 minutes.

The bad news is...... I was told there is no visa available for my wife who is waiting to re-united with me in the U.S. I am so lost and dont know what to do now. Like others in this website, we are trying to do all the process legally but nothing this is sad.

I guess I have to wait and wait and wait

OK - so one of the things about being an LPR -

is that you have to wait for the priority date to become current.

Once it's current - a visa number is available, and then and only then can Visa Application intake start at NVC.

So - study the monthly visa bulletin - learn when your priortity date becomes current - and then call into NVC that month.

Some caveats:

1. There is talk of a retrogression on priority dates for non-uscitizen petitioner-filed cases - you may have been affected by that .

2. NORMALLY a LPR-petitioner has to wait for a visa number to become available - it's not the same for USCitizen-petitioners...

3. Your casefile might have been sent off (as so many are) to NRC - the National Records Center - to await there in storage until the priority date becomes 'current'.

So - I suggest - you've some more studying to do - find out WHEN your priority date (listed in the receipt notice, NOA-1) will become current for your spouse's visa type... Also also try to learn if the casefile is being held at NVC or NRC. If at NVC - that'll cut down 1 to 2 months of waiting for casefile movement.

And another thing - your profile mentions that your Naturalization to become a USCitizen was approved - if that's indeed the case - I suggest NVC doesn't know about it and is treating that casefile AS IF you were a LPR. But back at post #1 - you mention that you're an LPR - soooooo... sorry - you must -- absolutely MUST wait - until the priority date for your case becomes 'current'.

I was checking the date, and it indicated that the cut off date is May 2012..... What does this mean?

I understand NVC did not even process the case, but can my wife go ahead and get the Police Certificate, and Medical exem now? Does it matter if we get this done a way before?
