Need help about getting married in another country..

Hi all. First off all if this post isn't at the right place I am sorry. I am a green card holder and I've been living in California for the last 2 years. I have never been in a trouble or something like that. I have a girlfriend in Turkey that I wanna get married soon. I have talked to a few friends and everyone says something different. I am extremely confused. They say I can not bring my girlfriend If I get married in Turkey. Is that right ? If so , isn't there any way to bring her here or do something else ? Please help me about this.

Hi Ercangenis,

She could apply for a tourist visa if you all got married for a visit but would not be able to immigrate (and may potentially be denied at the border depending on how they view her intent and what questions they ask her regardless of if you're married or not).

You can apply using the CR/IR-130 route but it'd actually be faster typically to get your citizenship and then petition her (with the CR/IR-130 once you have your citizenship) as it sounds like you've got a couple of years as a permanent resident already. Not 100% sure how long it is taking for a permanent resident's spouse currently but I think it is multiple years. Since you're not a citizen yet there's no K-1 route possible.

First of all thanks for fast responding Teripid. I have 3 more years to get my citizenship. Actually all I wanna do is , bring her here with me and live together until I get my citizenship. I honestly don't care if she has a social security or not. Thanks god I make enough to afford everything for both of us. I just don't want her to be denied at the border.

You can get married in Turkey. Those giving you advise has no knowledge of immigration.

Once you return to the US, you can file i130 for your wife. She will be under the F2A category (Spouse of LPR). Waiting time will be a year or more, depending on the movement of the F2A category in the Visa Bulletin.

She can visit you in the US via a tourist visa but she cannot live there permanently while the i130 is still in process. Over-staying the tourist visa is unforgivable for relatives of green card holders.

You can marry her in Turkey or anywhere else in the world as long as it is a legal marriage recognized by that government. You would then apply for the CR-1 for her but it will take several years for her to receive her visa.

I agree with Apple21. You may also want to look at the marriage process for Turkey. You have to get a special paper saying you are "free" to marry. This has to come from the Embassy. Since you are a LPR I would think it would need to come from the embassy of your home country, but I'm not really sure. But you will need to look into that. Plus everything else required to marry in Turkey. It can be a little complicated. Then once you get married file to bring her here.

Thanks a lot everyone! So If I get married in Turkey and bring her here with tourist visa , She would have to go Turkey once in six months , right ?

She doesn't get automatic 6 month stay in the US, whatever the immigration officer at POE gives her, she must stay within that period only.

Remember, even if a person holds a valid tourist visa, he/she may be denied entry if the immigration officer suspects that they are "living" in the US instead of just visiting. She needs to stay outside the US longer so as not to risk losing her visitation privileges.

If she gets a tourist visa the length of time she can stay in the US will be determined when she enters the country by Customs. It may be six days, it may be six months, it may be some amount in between. She has to remain outside the US more than she remains in the US. If she attempts to use the tourist visa to live in the US it will be cancelled and her chances of getting another will be almost zero.

Summary:

She cannot live in the US on a tourist visa and she must spend more time outside the US than inside.

Wow :( So I guess I'm just gonna get regular tourist visa and I'm gonna get married with here in here U.S. So she can stay with me until I get my citizenship. Otherwise there is no way that I can live with her here. This is sad.

Marry her in Turkey and file the i130. The sooner you do it, the better.

She may get the tourist visa, she may not. You can visit her instead. A tourist visa is not for permanently living in the US.

Sorry for being blunt, but that's reality.

She can't stay with you in the US.

But she can visit you, cause that's the tourist visa is all about.

The thing is , I have an awesome job and I make good money. So I don't wanna quit my job but I also love my gf. So prolly , I'm just gonna get her a student visa and have her study here. We don't have to get married to love each other :)
