HI!

Background: My wife has come over but we have waited 3 years to finish K-1 process. She just did her medicals and I am unsure about taxes.

The I-864 needs the past three years income. This year my taxes have been extended past the April 15th. I just started a business in November and needed more time. My question is can I send in 2012 tax return or do i need to wait till I finish 2013. Also do they need an official transcript from the government for 2013 tax return. Im guessing that will take a while if I file 2 weeks from now. Will they need special forms or documentation because I was self employed for November and December 2013? Lastly I do not have 2010 and 2011 tax returns but i made the same amount of money or close can I just use the same income amount? Thanks for any help.

Timeline

They use your income from your most recent tax return when self-employed, so filing an extension and not having the tax return to show will most likely result in an RFE. You can get your tax transcripts here. You need the Total Income from the last 3 years > http://www.irs.gov/Individuals/Get-Transcript

You can wait until you can get the IRS transcript, or send the AOS paperwork right after you file. You can send a complete copy of your return with all forms, schedules, attachments and 1099s instead of a transcript.
