Need help: i-864 Afraid now.

Timeline

Presently I have a household of 4 but last year I had 5. One dependent moved out this year. So I was happy because I didn't need a cosponsor but I found out I have to list all dependents from 2013 tax return. My mother who is in my household and is a dependent receives a small ssa check but its enough to give me that 2,000 difference. my concern is...having to prove why she hasn't filed taxes.(which legally she doesn't have to) How do I word that letter so that it doesn't cause a concern as to whether or not my husband will become a burden to the USA. I make enough without having to list my nephew that moved out. I afraid Im giving a reason to the nvc or embassy to deny our petition.

Also...if I were to find a part time job within this month would it be enough time to prove my income is enough to sponsor alone?

Why do you have to write a letter for your mom unless she is co-sponsoring or you are using her income and yours to combine.

If so you merely write a letter like you said why she was not required to file her taxes.

You don't get denied at embassy for not making enough you get a 221g and a span of time to get a co-sponsor. No need to worry.

Now the nephew that moved out you did declare him on your 2013 so he is included in your household you list.

You were talking about a denial and that would be the Embassy. The NVC doesn't deny or approve anything. They are a document intake facility and accept out packages and forms nothing more.

And yes the embassy can hold you up f your affidavit of support is lacking. You usually get up to a year to get a co-sponsor.

Just getting a job to satisfy the affidavit of support rarely flies because they know you will probably quite soon as immigrant is in US. usually they want to see some time in job not just recent employment. So know a history of work.

many people assume because NVC accepted their I-864 its okay and that's not the case. Sole decision is on the CO. All NVC cares is the #'s are they above the guidelines.

If your income is that near pr below guideline (and Lagos does what previous year and current tt meet guideline) than do get a co-sponsor now.

ok will do...my concern is my mom receives only about 6,000 in ssa benefits a year. I know its enough to put me at where I need to be but the fact that she ONLY gets 6,000 be an issue with the embassy? I could ask another person to cosponsor who makes more but im very reluctant to involve others.

Why not submit the I-864 and I-864a to NVC get through that and see what happens at interview. But Ii would surely have a co-sponsor lined up in case that course of action is rejected.

I wouldn't want to waste time at all. If its going to be a problem with embassy with my mothers income I do not want to risk it. I'll have to swallow my pride and ask someone to cosponsor. ugh lol whatever its takes. I gotta do it. Its too bad I have to keep my nephew on there. smh.

The mother can fill out an I-864A as a household member and have her income combined with yours to meet the income requirement. She does not have to make enough on her own or be a joint sponsor. If her income combined with yours is enough, then why not go that route? She just needs a statement as to why she was not legally required to file taxes. You can get a benefit verification letter from the SSA that shows what she makes, and even get a letter that she did not file taxes from the IRS, if you wish > http://www.irs.gov/Individuals/Get-Transcript

If her income combined with mine will put me where i need to be im happy and i hope the embassy will be satisfied and not give us any issues.....then i have no worries. i just wasn't sure.
