Hi everyone! This is my first post on Visa Journey, so excuse me if these questions have already been answered.

My husband arrived on a K1 visa in February and we got married earlier this month.

We are currently filing our AOS paperwork, and I have a few questions about form I864:

I don't have Federal tax returns for the past three years, only for the last two.

So we thought about having my mom co-sponsor my husband. Is that necessary?

We live in Chicago, and my mom and dad live in Michigan. Can my mom still be a co-sponsor even if we don't live at her place?

If yes, do we both have to file an I864? Is any I864A necessary ?

I'd understand that if we both (my mom and I) file an I864, on part 1 I'd check box 1.a and she'd check box 1.d. Is that correct?

How would we count household members on Part 5 of each form?

Does she have to list me in the household members in Part 5, as we don't live in the same place?

Also, she's filing I864, but on her tax return it's both her and my dad together.

So on Part 6 of the form, I assume she needs to list my dad. Should she check box 11 of Part 6, and should they file an I864 A also? Or does he need to file an I864?

We're a bit lost there as it's even more complicated than the previous forms, so any help would be greatly appreciated!

Thanks!

If your current income for your household size is more than 125% of the poverty guidelines then you don't need Co-sponsor. You just need to add a Paper sheet explaining why you didn't file for the 3rd year. As long as your current income is more than 125% of poverty guidelines you don't need co-sponsor.

Actually, one year is all that is required. You can add additional years if you feel you need more evidence.

From the instruction:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income
tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to
maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns

for the three most recent years

Ok, thanks for your quick replies!

Would it be safer though to add a co-sponsor or is that totally unnecessary?

As long as income on recent tax return suffice the requirement then getting a co-sponsor is totally unnecessary.
