Letter from Embassy asked for approval of status as fiancee of US citizen???

Hello,

I would be hugely grateful to anyone who can help.

Last October my fiance and I filed our petition for a K-1 visa for myself. In January I received confirmation that my visa application had been received and a checklist of things to do and forms to compile before interview. I compiled the forms and have done everything except the medical interview. I thought all I had to do now was wait for the interview date. But today I received a letter saying the US Embassy (in London) is awaiting my 'approved petition according you status as a fiancee of a US citizen.' ???

I do not know what I should have sent them? I thought they already have confirmation that I'm the fiancee of a US citizen from all the documents we filed in the USA?

I'm worried I am delaying the process. Would be extremely grateful for your help, advice, insight. Thank you!

Hello,

So you received your NOA2 in January? Create a Timeline for your profile as it helps others see where you are with your application :)

Have you had your medical appointment? You need to do that and wait for the Embassy to receive the results before you they will schedule an interview for you.

If you've done your medical and got all your documents (birth certificate, police certificate, affidavit of support (if using that)) then you need to complete the following web form: http://london.usembassy.gov/iv/notification_of_applicant_readiness_form.html again BEFORE London will schedule an interview

Thank you Minnescota. I have a few questions which hopefully will be easy for you to answer.

Before I ask the questions, I will outline my visa journey so far for you:

Oct 2013 - my fiance and I filed the petition (form I-129f) to Homeland Security in USA.

Dec 2013 - received confirmation from Homeland Security in USA of petition have been received.

Jan 2014 - received NOA2 and checklist from US Embassy in London.

Since Jan 2014 - I have applied for and obtained my Police Certificate. My fiance has completed the Affadavit of Support and mailed it to me.

Questions:

(1) When I received the NOA2 and checklist in January I thought these were all things I had to do in preparation for the interview but did not think that I had to do them 'in order to get' the interview. I read the letter and checklist carefully but could not see anything that said these things had to be done in order to move the process on.

If you would not mind clarifying.... I think this is what I need to do:

Phone and book my medical exam;

Complete out the DS-160;

Complete the “Notification of Applicant Readiness” form. (http://london.usembassy.gov/iv/notification_of_applicant_readiness_form.htmland)

.... and then have I done all I need to do to get my interview and it's just a case of the Embassy notifying me of when it will be

(2) Do you know how long the wait usually is between submitting the “Notification of Applicant Readiness” form and the Interview Date itself?

(3) What is the time period that the application is valid, starting from the time of receiving the NOA2. i.e. I received my NOA2 in mid-January, long long did I have from that date to do all the things I needed to do and submit the Notification of Applicant Readiness? I'm worried I've delayed my application process.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Something is wrong with your understanding of what you received. Example- London does not send NOA2.

Fill in the dates:

(fiance) Filed I129F-

(fiance) Received NOA1 from USCIS (mailed notice that petition was received)- date?

(fiance) Received NOA2 from USCIS (mailed notice that petition was approved)- date?

(fiance) Received letter from NVC with new case number and saying file sent to London- date?

(you) Received letter from London with a web page link to find your forms and instructions. - date?

And the letter also had a date at the bottom which is your deadline for completing your visa.- deadline date?

It is difficult to help you until you get your timeline straight. And if you will take time to read Post #2 in that guide, maybe you can figure out for yourself where you are and what you have failed to do which is holding up your case. It also tells you in Post #2 what to do if you go past your deadline date given in the letter.

Keep reading and Post #4 discusses in red writing "how long" after your things are in.

Apologies to anyone who has had to repeat information or tell me things I should have known, I am just a bit confused and stressed by all this today.


As requested here is my timeline info that I know, I have missed a few things out and provided rough dates (i.e. the month rather than to the day) because I don't have the info to hand but I wanted to provide this information to you as quickly as possible:



(fiance) Filed I129F- October 2013


(fiance) Received NOA1 from USCIS (mailed notice that petition was received)- November 2013


(fiance) Received NOA2 from USCIS (mailed notice that petition was approved)- December 2013


(fiance) Received letter from NVC with new case number and saying file sent to London- date? Jan or Feb 2014


(you) Received letter from London with a web page link to find your forms and instructions. - 14 January


And the letter also had a date at the bottom which is your deadline for completing your visa.- It said 4 months from 13 Dec 2013, so 13 April 2014.



TODAY I received a letter stating "We refer to our communication concerning the receipt of an approved petition according you status as a fiance(e) of a United States citizen. As of this date we have had no reply from you. Please inform us within sixty days whether you intend to process with an application for a non-immigrant visa to marry and reside in the United States. We would appreciate a response even if you wish to abandon the applciation. Sincerely, Chief, Immigrant Visa Branch."



Looking at some info online I see that, because 13 April 2014 has passed, I need, in addition to the other things I'm doing, to get my fiance to send a notarized letter stating that he still intends to marry me, which I should bring to my interview.



So I think what I need to do is:


(a) complete DS160


(b) submit “Notification of Applicant Readiness” form


© attend medical exam (i've booked it for 2 May)


(d) take notarized letter of intent to marry (that my fiance will write and send to me) to my interview.



I will also write a letter myself to the Immigrant Visa Branch in London, stating that I still intend to marry a US citizen.



As long as I do all of the above I think everything is okay?



Again, sincere apologies to anyone who feels I am being stupid or asking obvious questions. Just stressed and overwhelmed by this right now and concerned I have done something wrong. Thank you everyone who gives or has given advice.

YES. Those are the things to do. They were ready for you to do that in January. Their letter today is a follow up to find out if you are going to apply for the visa or not. By sending the DS-160 and Readiness form, that lets them know you are still in the game, so you don't really need to write a letter.

Your first post in this thread said your letter today stated they "were awaiting your approved petition". That would indicate your file had never even reached LoNdon from NVC.....thus the confusion knowing how to answer you. Your clarification makes sense. They have your petition file and are waiting on you to apply and have a medical. You are fine, just caused yourself an extra 3 months, but are on track now.

I actually did not receive my police certificate till March so could not have booked the medical exam till then, so I think I've only cost myself one extra month really. I'm annoyed to have cost myself any extra time at all but relieved to know I'm on track. Thank you again.
