Hi fellows!

I was hoping someone could help me. I am AOSing through marriage to a US citizen. Last week we've got an email saying they sent us a RFE and today I finally got it in the mail, after obsessing for days about what it could be! It is a pink letter and, as I suspected, it has something to do with the I-864.

WHAT IT SAYS:

"Submit a complete federal income tax return submitted to the IRS from the petitioner/sponsor on form I-864, Affidavit of Support, for the most recent tax yerar."

And then, handwritten: "W2 alone are not acceptable or required."

WHAT WE'VE SENT:

Copies of his W2s, that together show my husband earned $19487 in 2013. It is a little bit under the new 125% poverty line for this year, so we've also sent a statement from our checkings + savings showing around $25000, which is more than 3 times the difference.

MY QUESTIONS:

- We hadn't sent the complete return because my husband hadn't filed his taxes at the time we sent the package. He filed his taxes last week. Should we just go to the HR block site and print them and that's all they want?

- They are not saying his income is not enough, right? He just got promoted to a full time job in the same company and his new income is $40000 a year. Should I also send a letter explaining that plus a letter from his job, even though they didn't ask for it? Also, we now have benefits! Yay! Can I send that also?

I thank you guys in advance. I know this is the most common RFE people get and that I could have found the answer for my questions on other peoples posts! but I really wanna nail this!

No, that means they haven't processed your return yet so you can print that but you would also need to provide copies of your W2's (again).

Instead of using assets just provide recent pay slips and a letter from his employer that proves his current income, it will be a lot easier that way but you may need to complete another I864 to correct it.

How long do you think it would take to have the Refund Transcript? Because if it's only a matter of days, I would prefer to wait and send that.

And should I send another i864 or wait for them to ask me? He has been in this new position for only a month..so we can send only two pay stubs...

Timeline

If the current annual income is not at least $19,662 for a household size of 2, then do not get rid of including the assets. They are not questioning the income/assets. The RFE is because you did not supply a complete copy of your most recent tax return. Just provide a complete copy of the return with all forms, schedules, attachments, W-2s and/or 1099s. It works the same as a transcript. You just have to send a copy of the complete return.

So I shouldn't bother showing them he got a new job? I can always bring this information (with a new i864) later to the interview!

Also, do I have to send everything again, even what they already have (W2s, assets)? But no i864?

Send in the transcript, and if you like add in the new letter from the new employer stating his new salary. You can add in an updated I-864 to reflect the new income amount. State the reason for the new I-864 and letter from employer.

If I were you I would send New I-864 with current annual income, Letter from Employer stating his current position and annual salary, recent pay stubs along with 2013 IRS federal tax return transcripts and W-2s. I would also add a Paper sheet to explain reason for sending new I-864 ( Promotion in Job and Increase in salary). Hope it helps. Good luck.

February 28- AOS package sent. ( I-130, I-485, I-765)
March 5- Package delivered to USCIS Chicago.
March 11- Email and text notification with Receipt Numbers.
March 14- Hardcopy of NOA1 for all three applications.
March 21- Received biometrics appointment letter for 04/04/2014
April 2 - Completed Walk in Biometrics appointment successfully. (Original Appointment was for 4th April)
April 9- I-485 Case status has been updated to " Testing & Interview "
April 16- Text and email alert for case update for AOS interview on 22nd May 2014.
April 18- Hardcopy of Interview notice received in mail.
May 22- AOS interview, approved on the spot and got stamp in my passport.
May 27 - Approval notice of I-130 and I-485 in mail.
May 29- Received GC in mail.

ROC Timeline:

03/28/2016: I-751 package sent to CSC

03/29/2016: Package delivered.

03/31/2016: cheque cached.

04/02/2016: Received NOA1 in mail, dated 03/29/2016.

04/13/2016: Received Biometrics notice for the date of 04/25/2016.

04/21/2016: Early walk in Biometrics

09/28/2016: Text and email alert about approval of ROC

10/06/2016: Received 10-years green card in mail

Yes, that is all you need. Shows your Total Income is $19,613. That is why IRS transcripts are good to use. Less pages to print because all the info is condensed and contained in a few pages. And, you do not need the last 3 years because you are only required to submit the most recent year and that is what your RFE asked for.
