Hi everybody,

So as my husband does not make enough, we are having my father in law as a joint sponsor, he is re-married. My question is, does my joint sponsors spouse needs to file any forms, or its enough to mention her (name, relationship and income) in form I-864? And do I need evidence of her income too? She is refusing to give any information of hers, so I really need to find out how it all works with sponsorship.

And could anyone please guide me, where to find a list of what evidence my joint sponsor has to provide?

Your joint sponsor needs to fill form I864 with supporting documents.copy of birth certifcate,copy of green card or passport information page.tax transcript.

If the spouse does not want to provide their income for sponsorship, then the joint sponsor needs to have income for their household size plus the intending immigrant all on their own, and will fill out the I-864, provide their joint transcript and also their W-2 to show their individual income. For current annual income, they will list only their individual income and they will not list their spouse's name or income anywhere on the I-864, The only mention of the spouse will be when they put 1 for Part 5 #3, and of course the spouse will be shown in their joint tax return.

so they got married in august and my sponsor filed taxes as single. can I just not mention his wife in a form at all?

There is no need for that, she just needs to be counted as a member of the household nothing further.
