AOS & EAD

Hi all,

I'm still confused! My fiancé who came to the US on 12/22/2013, who is now my husband. We got married on 12/31/2013. We already applied for AOS and EAD. His I-94 expired in March 2014. My question is if my husband wants to apply for a driver license how do we got about this in CA? Because our I-94 is expired and the DMV (department of motor vehicle) is saying they will only approve the I-94. but what do we do if I-94 is expired and my husband is currently waiting for his EAD and his AOS approval. It feels like my husband is stuck and not able to do anything until all this is approved...what do you guys think?

Her husband can't get a driver license because his I-94 expired which means he is here illegal. Since he has applied for AOS and EAD, he is now allow to stay until his case finalized. He will need to wait and get his EAD and then he can get SSN and apply for driver license. I am sorry that your has to go through this but there is nothing he do but wait.

He is not illegal. He is out of status.

Since his I-94 is expired then he is able to apply for driver license when he receive green card, i'm not sure if he could apply for it when he gets his EAD.

Hi, I think you are looking for your husband's 90 day visa validity. The I-94 normally expires 11 months upon entering. So it means the I-94 is still good and once his EAD get approve then he can start getting his driver's license.

I-94 is valid for 90 days (3months), not 11 months. It's written in the I-94 paper.

11 months? I-94 typically is given for 90 days to a K-1 entrant.
