Abused wife please help

Hi i dont know how to start this. My husband is abusing me and my children. I am completely lost right now. Im a conditional green card holder and i want to file a VAWA petition for me and my kids. Techinically my kids are not residents yet because their green cards are still pending. My husband verbally and physically abuses me and threatens me, my kids and my whole family in the Philippines. I have the evidences that will prove that. Please help. Is there a possibility that my kids are going to be sent home? I dont know whats going to happen

Since you have your conditional green card you are good to go. The children are another story.

Right now your number one priority should be to remove yourself and your children from the situation. Call the police, go to a shelter, find a relative or friend you can stay with.

After removing yourself from the situation then you can worry about the rest.

Just a note, take with you any papers proving you had a real marriage such as bank statements from joint accounts, bills with both your names, copies of insurance policies with both names, anything that proves you lived together and had joint accounts.

You need to first remove you and your children from the situation, google shelters in your area and go to one - explain your situation. Shelters are very welcoming.

Do not tell your husband where and when you're leaving, as this could be dangerous and he could be even more abusive. The important part is getting out!

If you have all the proof of the abuse, definitely file a police report and get a restraining order so he cannot come after you, OR your children.

If you need to talk, I am an abuse counsellor and can talk with you further through private message.

PLEASE get out now, do not wait in worry about your childrens immigrant status - that wont be helpful if something bad happens to you or those kids.

Why would the first thing that crossed your mind in such a situation be to ask about VAWA on an online forum?

i want to protect me and my kids and i dont know how to do that. He has been threatening us

YOU don't need to file a VAWA as you already have a green card.

What about my kids though? Will thet be out of status?

go to the criminal court in your county courthouse, and file it there.

usually, it's a lawyer that does the filing,

but

if you hook up with an organization mentioned earlier in your topic, they can assist you with the wording on filing a restraining order.

Abuse is a terrible thing. Might be safest for you and your children to leave by taking them back to the safety of your family in the Philippines. Start divorce proceedings from there. Its very unlikely your spouse is going to chase you across the globe to continue the abuse.

She doesn't need to go to the Philippines to escape abuse.

Just leave the house you share with him and then seek help. You should be fine.
