Question on proof of U.S domicile

I have a question regarding proof of U.S domicile. I am the USC and my wife is from Belarus. Since Winter 2011 we have been in residing in Turkey together. Now, back in US I do not own a house or vehicle. I do not have mutual funds either. I transferred all my savings with me when I was moving to Turkey with her and helped my mum & dad to get an apartment here.. I see a lot of items in the lists regarding proof of domicile but how can a person in my shoes prove all items in the lists? For example, bank accounts might not be that hard but how can one get the voter registration without being present in U.S? I believe you have to be a permanent resident of the state that you're living in order to get that.. Or my driver's license which will expire in a few months. You can not renew that without being in US either.


Any help is appreciated.

there are 2 paths you can choose, for proving up domicile stuff during NVC doc intake OR during the interview:

1. proof of existing USA Domicile or

2. proof of re-establishing USA Domicile

i think you should take path #2, which would include:

1. letter of employment offer and

2. signed lease from a landlord on a property in the USA.

You not need to physically move back for those 2 things to occur, prior to interview day, but...

Path 1 , at the moment, is not available for you, as you DID NOT MAINTAIN your USA domicile at all.

Well, it sounds a lot like you don't currently have US domicile. You should probably look up "re-establishing domicile" and see what you can achieve (job seeking, house seeking, planning the move etc.).

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

 

* How? Read my DCF London I-130 for CR1/IR1 Spouse Guide

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Hmm. Thanks Darnel and Lost. You guys are right, I did not maintain that per se, but I still get mails to my old address from school, bank etc. I have lived there many years with my roommate and I still have that address on my drivers licence which will expire in March. I'm thinking of maybe going to U.S for a week to renew the license if I can.

Other than that the AOS is another problem. Hopefully my boss back in US whom I worked 7 years for, will be a sponsor as well. I did get a letter from him stating that he'd be pleased to have me and my wife both work again for him. I don't know if that would be enough.

a returning expat , getting a lease, would show a lease start date 2 weeks to 4 months after the interview date.

you'll know the interview date 20 to 45 days before the interview,

so,

you have some time to chase after a lease. not much, but enough. If you show the 2 items I referenced on interview day, well, you'll meet the domicile requirement.

I think you are confusing the immediacy of the 'now' with what must be shown on interview day. I've set up a lease in the USA when I was moving back from Singapura, remotely. So I know it's do-able.

Hi Darnell, My husband and I will be in the same situation when and if we get to our interview stage

while my husband has his US bank Acc with letters been sent to his mothers address in the US

His car still there with his name on the title (but expired license)

we would also be looking into apartments after we move there, we have one picked out online that we would like to view but how are we supposed to get a lease to this place to show proof of re-establishing domicile? We are not there physically and feel we won't be able to get a lease from the tenant.

Any suggestions?
