Hi guys,

I guess a lot of you read the post I made last week about the rather confusing RFE we got last week. Although our RFE was related to the medical, it wasn't because they lost it or weren't accepting the vaccination portion, which seems to be happening a lot lately. This RFE was just simply incorrect.

Emphasis is my own:

You have submitted Form I-693, Medical Examination of Aliens Seeking Adjustment of Status; however the date that the civil surgeon certified the exam is more than oen year from the date the applicant filed the Form I-485. In order to process your application further, you need to submit a properly completed and signed Form I-693, Report of Medical Examination and Vaccination Record, (Rev. 06/05/08 or later) for the applicant on Form I-485. The medical examination must be conducted by a civil surgeon who has been designated by USCIS.

Visa Medical: April 28, 2009 (9 months ago - 9<12, so what's the issue?!)

Transcription: December 2009 (1 month ago - 1<12, so what's the issue?!)

Filing: December 2009 (1 month ago - so what's the ISSUE?!)

We got a lot of feedback on the letter we proposed writing (thanks!), but I had the post taken down less than a day later when I realized that I'd left our full address on it - I got the full name and the case numbers XXXXXXed out, but not that - sorry.

We gathered together all the proof we had of the dates of the various medical related appointments (DS3025 w/ exam date, copy of I-693 from CS), and were prepared to respond, but I wanted to get as much information as we could from as many sources as possible about what to do. Both Nik and I were feeling extremely adverse to just going along quietly with what we knew was just WRONG, so we didn't want to go get another medical just to make things go more smoothly. We scheduled an infopass and called the misinformation line.

The next step we took was to investigate a bit with the immigration specialists who worked for our congressional representatives. One initiated a congressional inquiry, the result of which was that this incomprehensible RFE was taken off of our file (or so we are told now).

My current plan is to continue with the infopass just to be sure that stuck, and then to file away the RFE with the email from the Analyst from the National Benefits Center regarding our case.

Anyway, I hope if other people get RFEs that don't make sense, this will help them out to decide what sort of steps they can take to get back on track. I'm sorry that it doesn't seem to shed much light on those who are actually asked for a whole new medical.

Other (maybe) pertinent facts:

NO skin TB test (but aren't done processing yet!)

Incomplete vaccinations were finished in the US

I-693 vaccination portion filled out by CS and sent with original application

Wow, im sorry you had to go through all this! Im glad its being taken care of
