I am back from my interview and the decision was no decision. My case was returned to the State Department for consultation with their in-house lawyers. US Consulate in Rio de Janeiro did not know how to apply the law to my case. The issue is what to do because my I-94 was valid for 15 months and not 90 days as it should have been. Obviously, my I-94 is incorrect so what to do now? US Consulate doesnt know so they kicked it back to the State Dept. What is your crystal ball telling you?

My crystal ball says - They didn't call the immigration judge on interview day, or after interview day. If you supplied his cell number, why didn't they call him?

as for going forward -

if the casefile is still at the consulate - then is possible to have the immigration judge phone them, speak about your case to them. It may be pegged to go back, but still physically there.

if it's left already (doubtful ) then you'll have to wait until the USC Spouse receives a letter back from USCIS. If the letter states some action to do, then have the USC Spouse 'do that action'.
