I was just wondering if there is anyone out there who didn't get a K-1 visa to get married in the states.. I came here B/F lived in Washington me just over the Canadian border. came here just for a trip found out his family was relocating to Utah and he was going with them.. Not wanting to lose him i just stayed, we had been together for 5 years anyways so just decided to get married. I didn't go back haven't been back since no visa nothing just got married. I have been looking through the forums and it seems everyone did the K-1 visa.. has anybody had any success in my situation???Like will my timeline for receiving EAD take longer or is it generally the same??? Or are my chances lower of getting approved because of the way i did things?
THANK YOU!! |

Unless you have an extended visa that allows you to stay in the U.S., you're out of status and it's possible that if/when you file for adjustment of status you could be deported and incur a 3 year ban.
You've got a loooong road ahead of you if that's the case. This post has been edited by Justine+David: Nov 3 2009, 02:15 AM -------------------- 8/2007: Met randomly in Toronto at a Harry Potter conference

If you are denyed and get the ban and deported there is NO appeal for this as you entered as a tourist. Do I have any other option? When i spoke to the lawyer she told me that everything should be fine i never got an i-94 since i am canadian.. she told me that they might make me go back to canada to wait for a decision but that there was a paper i could file stating how much grief it would cause me something of the sort.. I mean i haven't done anything wrong i am not working or doing anything i am just living. What is the likleyhood that i will get deported? I wasn't nervous about filing but now i am lol.. |

Lawyers are hard to follow a lot of them are not up-todate and a lot of them are not aware of things that they should be!! If they make you go back thats deportation with a ban for being illegal. I can't out right say that you WILL be denyed but there is a chance and it could be a 50/50 chance. Im going to guess that you didnt know about all the paperwork and everything involved with getting a visa to get married or getting a visa when you are married to come live in america? which is ok it happens. Its good that you arent working cus that could make it worse, do you have a passport that is valid and or any valid ID? -------------------- 10-01-2009 : Sent AOS to Chicago

I don't want to have go back... but i guess all i can do is pretty much file the papers and see what happens. |

I would suggest looking on the passport canada website and applying for that too asap if you can. Your going to need a copy of your full birth certificate, not the small card but the big long one with your parents names and all that on it. You will also likely need a full medical from a civil surgeon as well since you didnt have one before. Your going to want to look at the I-130 forms and the I-485 and file them both at the same time!!!! if you dont there will be problems. -------------------- 10-01-2009 : Sent AOS to Chicago
