I was just wondering if there is anyone out there who didn't get a K-1 visa to get married in the states.. I came here B/F lived in Washington me just over the Canadian border. came here just for a trip found out his family was relocating to Utah and he was going with them.. Not wanting to lose him i just stayed, we had been together for 5 years anyways so just decided to get married. I didn't go back haven't been back since no visa nothing just got married. I have been looking through the forums and it seems everyone did the K-1 visa.. has anybody had any success in my situation???Like will my timeline for receiving EAD take longer or is it generally the same??? Or are my chances lower of getting approved because of the way i did things?

Unless you have an extended visa that allows you to stay in the U.S., you're out of status and it's possible that if/when you file for adjustment of status you could be deported and incur a 3 year ban.

If you are denyed and get the ban and deported there is NO appeal for this as you entered as a tourist.

I don't want to have go back... but i guess all i can do is pretty much file the papers and see what happens. for going to Biometrics you will need a valid ID, you MIGHT want to get a canadian passport if you can as soon as you can, just incase you do get deported and it can also help you get other IDs after you get your AOS as well as help you with traveling! I would suggest looking on the passport canada website and applying for that too asap if you can. Your going to need a copy of your full birth certificate, not the small card but the big long one with your parents names and all that on it. You will also likely need a full medical from a civil surgeon as well since you didnt have one before. Your going to want to look at the I-130 forms and the I-485 and file them both at the same time!!!! if you dont there will be problems. -------------------- 10-01-2009 : Sent AOS to Chicago

The cost for canadian passport is around 90$ i think?
The I-130 is 355$ The I-485 is 1010$ Do two seperate checks paper clipped to the cover page of the respective forms. Good im tryin to locate the page that says you have to have the long form one or it will be rejected but I cant find it... I know you do have to have the long one tho !!
