No Name on Birth Certificate - Please help!!!

Hi everyone,

This is my problem. Today I submited my documents at VFS for K1 visa. I submited all the necessary docs there. But when they asked for my birth certicate original and copy of the same then I gave it to them. Then I wanted to submit a copy of school certificate ( secondary evidence ) since my name is not mentioned on my birth certificate. Its very common in India.

But the lady at VFS refused to take copy of school certificate 'coz I didn't have my original 10th certificate at that time. I didn't know that I have to take original with me there. :crying:

She just took copy of my birth certificate along with my original birth cert.

But she made it clear that I need to bring an affidavit for that name thingie and my 10th certificate original along with photocopy to the interview otherwise I'll get a 221 (g) :(

I have my baptism certificate. I'll use that too. My name is mentioned on that.

I have the following questions :-

1) Now my question is do I need to get that affidavit from First Class Magistrate or a simple notary ?

2) At which point in my interview I have to submit those documents?

My interview is on 23rd March at Delhi Embassy. So please help. I have only 12 days in hand. :help:

9-22-2008 - mailed I-129F

9-23-2008 - Arrived at CSC @ 10.06 a.m. signed by BOBENG

9-24-2008 - Check cleared, touched, NOA1

9-25-2008 - touched

9-26-2008 - touched again!

9-29-2008 - Received NOA1 in mail

1-09-2009 - Received NOA2 e-mail notification @ 7:04 p.m. EST (I was online at the time) ;) in 107 days!

1-12-2009 - touch

1-15-2009 - Received NOA2 in mail, arrived @ NVC

1-20-2009 - Left NVC

1-23-2009 - Rcvd letter from NVC

1-24-2009 - Arrived @ Embassy

2-03-2009 - Packet 3 mailed from Embassy

2-09-2009 - Packet 3 Received

2-10-2009 - Packet 3 Sent back to Embassy

2-23-2009 - Packet 4 mailed from Embassy

2-28-2009 - Packet 4 Received

3-02-2009 - Medical done

3-23-2009 - Interview @ Delhi Embassy --- Got 221g

3-31-2009 - Returned 221g additional evidence request -- submitted tons of pictures (80), handwritten letters etc.

4-08-2009 - Received visa!!!

4-19-2009 - POE

5-09-2009 - Wedding

Bummer that your additional proof wasn't accepted at the VFS office. :angry: Anyway just be ready at the interview with the additional proof. :thumbs:

I am not sure of the differences of a "First Class Magistrate or a simple notary", and neither is my husband. :bonk: Anyway, below is the Affidavit that he gave at the Consulate, it is signed by someone who is a "Advocate and Notary". My advice would be to get the best thing you can - if that is a first class magistrate, go for it!

I would say follow the lead of the person conducting the interview - if they ask for certain things, give them. Answer only questions they ask and keep it short. Offering too much info sometimes backfires. :whistle:

Finally, follow your heart and go with the flow, and GOOD LUCK for an INSTANT APPROVAL!! :star:

-- Simple notary will work, but to be more certain do email Delhi consulate and ask them.

--When you go for your interview, before the actual interview, there is a small interview with an Indian CO, who verifies all the documents submitted, most probably you will have to submit your 10th pass certificate and other proofs at that point of time. But as ELW said, don't offer till the time you aren't asked.

ps-- The affidavit ELW has posted is done by notary public, so you will be safe with doing it with any notary public rather than going to Megistrate.

Thanx guys for the timely help. Now I know what to do. Earlier I was scared and totally blank but now I know a lot.

I'll get that affidavit done day after tomorrow but before that I'll call the embassy.

And I'll try to bring to their notice before the actual interview. =)

Most probably I'll talk to that indian consular officer. :)
