DV Lottery of K1 Visa - Can I file for both?
I applied for the DV lottery 2025 and hope to be selected this year. My fiancé and I discovered that there is a fiancé visa for the USA. Do you think if we apply for the K1 visa but are selected for the DV lottery that we can stop the fiancé visa process? What are the timelines and options here :)?

    Confused about steps after marriage
My fiancee arrived last month on K1 fiance visa and we got married yesterday. It seems from what I have seen online that I made a mistake by not getting SSN prior to marriage? I am going to the SSN office on Monday to gather more information... also worried about employment authorization and travel authorization(s). Thanks for any insights!

Tourist visa cancelled by CBP agent. Can we still get a CR1 or K1 Visa?
Upon my gf's most recent arrival, her tourist visa was cancelled at the airport due to her frequent visits last year and suspicion of working here. She was denied entry and sent back same day. Is a CR1 or K1 visa process an option still? I would appreciate any advice or tips you can provide!

K1 Visa Medical Exam with Dr. Cheema (Surrey, BC) REVIEW

Leaving a review of my experience to hopefully help others after me!

    Medical Exam date: April 18, 2024 @ 9:00am

Cost: $355 for my age range, plus $50 for a TDAP booster & $47 for tracked courier delivery of some documents to my house

    Booking the appointment:
I emailed the office directly after received my packet 4 email with all the documents they require, you can find this information on their website, make sure you ve received your packet 4 email first and that you ve booked an interview appointment as they will ask for confirmation for both. They responded to me immediately and I was able to book my appointment for about a month away from that day. They respond very quickly and if you have any questions they ll answer anything you need.

    Appointment day:
I flew in from Calgary really early and landed at 6:30am at the Vancouver airport, rented a car and drove down to Surrey. It only took about 30 min to get to the office from the airport, it was really easy and there was no traffic. I arrived around 7:45am, and decided to go in to ask some questions about my vaccines as I only had one dose of the Varicella and they ask for two. Since I was already there they actually told me they would take all my documents and start the process right away. They asked for my 5 passport photos, my passport, my drivers license, my covid vaccination records, as well as my other vaccination records. My records are all in spanish and I translated them on a google doc and printed that to bring, I showed them the original plus the translation and they took both to double check everything matched and make copies of everything. They gave me a form to fill and then returned all my documents afterwards, then they let me know I was actually missing a TDAP booster since it had been more than 10 years since my last dose, and I chose to get it there so I paid $50 for that. I sat down and waited a bit longer, then I got called in to the room. Dr. Cheema was really nice and went through the short list of questions really quickly, he listened to my lungs, took my blood pressure, then palpated my stomach, and finally gave me the TDAP booster before sending me on my way. I was finished by 8:45am, 15 min before my official appointment time, and then had to wait 15min after the vaccine before I could leave. The blood test is by appointment only and the office will make it for you and give you the time, the lab is right next to the office so you can walk there. I headed to my blood test appointment and I had to wait a bit as it was busy but I was out by 9:45. Then I drove down the road to the x-ray lab which is walk-in only, and despite being busy I was seen basically right away. I missed my turn into the parking lot so I wasted some time turning around, but I was finished with the whole process a few minutes before 11am. All in all it was really quick and easy.

Total time: around 3 hours and 15min.

    What I learned:

    • Hepatitis A is not required.
    • Tdap is required within the last 10 years (I got it at the office)
    • Varicella requires two doses, if you do not have both or records of both, you can get your family physician to get bloodwork done to test for immunity. If it is reactive, you are immune. An additional dose if needed at the office would have been $95.00 CAD, but if you ve had chickenpox before you just need to tell them what year you had it, no proof necessary.
    • They provide you with a CD (for border crossing) and vaccination record (for AOS) by mail - you can choose courier (free and not tracked), or tracked courier (depends on where you live but I paid $47), they told me both of these are not required for the interview.
    • Once results are sent to the US embassy, you will receive an email stating so.

    Hello,

I know you cannot travel for more than 180 days. Does anyone know if that is in a calendar year ? or From the time you received your green card? My husband has a pending N400 and since receiving his green card he has been on some trips and vacations and has been outside the country 85 days so far in total over the past 3 years. Is he allowed to keep traveling while the N400 is pending ?

None of the above matters in the context of the affidavit of support. This sponsor is a self employed investor. His current income will be the "Total Income" figure from his latest (should be 2023) US Federal tax return. AGI (might be the same number) is irrelevant to a self employed person. Self employed never file a 1040 EZ.

Two sections of the affidavit to enter income. The past tax returns section, and the current income section. Unique to the self employed is that the most recent income reported in the tax section is the same as the "current income" as it is not "income" (again, in this context) until it appears on the tax return. In this situation the total income will be the capital gains minus applicable losses. It doesn't matter whether the gains were long term or short term. If they are included in the plus side, then the plus minus the minus, is the "total income".

A "Self Employed Investor" with ample capital gains income, would also declare and document the underlying investment capital in the asset section of the affidavit, further supporting their qualification to sponsor the immigrant.

Thank you for the Response, I have an additional question, Like OP, I have meet the income requirements for the last 3 years through my capital gains. Those gains were all in cryptocurrency. So to prove my assets is going to be difficult. I have 150k in my own cryptocurrency wallet.. and 50k in gold in a vault back in the US.

How do can I prove that this is mine? The gold I have several purchase receipt, so would pictures of the gold and a receipts suffice?

As for the crypto... I could easily "sign a transaction" and prove they are my funds, but I dont think the NVC will have a clue what that means.

I can't get a joint sponsor right now
    Thanks

    Ir-2 passed Medical, Ir-1 failed?

Ir-2 passed medical at St.Lukes, Ir-1 (wife) failed X-ray, which really blows. Wife is down. Do we still proceed with son's interview or delay for wife, having to wait 2 weeks for sputum, then 2+ months for results, then trying to schedule IV appointment?

Also, I'm thinking about moving out of California since we were already planning to get out of my birthplace state, which I can't deal with the politics anymore. Is it difficult to get the Visa's moved to a new address during this time, after submitting everything, not to miss in the mail?

    Thanks for any advice.

Before Getting to the US: Any Preparations in Advance to Help with AOS?

Hello, I m the Filipino beneficiary. I am hoping to get my K1 visa issued within this month.

I was reading on posts here that it is very important to marry AND file for AOS within 90 days. What I know so far is, when I get to the States:

    1. Apply for SSN

    2. Marry

    3. File AOS

    4. Name change on SSN (later on, not sure when)

If that s wrong please correct me. My main question though is this: given this timeframe right now, where my fiance and I are still not together in person in the US, are there any specific steps we can take in advance as of right now? Just based on everyone s experience, was there any document you wished you have requested or applied for earlier, or is everything a pretty smooth process?

Just a little concerned, because it looks like many couples file for AOS past 90 days. It made me wonder whether it was very time-consuming to gather documents or something.

      Hello Leslie,

I was looking at your timeline and saw you sent in form I29F after filing the i130. It seems that everything went so quick for your process. Do you think sending in the i29F is worth it and might speed up the i130?
What steps can you suggest ?

      Thank you!

Hey Shawnk, I am in a similar situation as you with my timelines. Someone recommended the same process as you mentioned to get a dual working visa. Do you have more detail on what dual intent working visa entails? What do i need to prove to get one.

      Thanks!!

I797C Notice of Action Rejection Notice
I recieved a I-797C Notice of Action rejection Notice for not answering one question. I want to resubmit correcting it. My question is can I resend the 535 cashier check that was stamped by USCIS and sent back to me? And include a second cashier's check with it for the difference for the new filing fee? Is my 535 cashier check still good since no case was processed?
